OSHA Releases Guidance on Restroom Access for Transgender Employees

Last week, the Office of Health and Safety Administration (OSHA) released a best practices guide for employers regarding transgender employees’ access to restrooms. Although not enforceable law, the guide should not be overlooked by employers. The Department of Justice (DOJ) and the Equal Employment Opportunity Commission (EEOC) have interpreted Title VII of the Civil Rights Act to include discrimination based on gender identity or transgender status and have sanctioned employers for failing to provide transgender employees with safe and healthy workplaces. The guide includes a model policy and provides examples of model State regulations that ensure transgender employees have access to appropriate restrooms.
