EEOC Sends Proposed Rule on Employee Wellness Programs to OMB

The Equal Employment Opportunity Commission (EEOC) sent to the Office of Management and Budget (OMB) its proposed regulations for employer sponsored wellness programs designed under the ACA. Following OMB approval, the EEOC will submit the proposed regulations for public notice and comment. The regulations will provide guidance for employers on the interplay between wellness programs and the ADA. Since the EEOC filed suit against three companies in 2014, for having discriminatory wellness programs, some employers have been calling for the EEOC to provide guidance on wellness programs.
